Three-Point Protection ProgramSM  Terms and Conditions
We, Transport Executives, want our customers to have a positive experience with our company and the carrier with whom we contract to satisfy your shipment. In order to demonstrate our commitment to you, we offer the following three points, cumulatively known as the Three-Point Protection ProgramSM

Point One: No Up-Front Fee
Transport Executives will not charge you a fee until the point in time that your vehicle has been dispatched. Dispatched means that we have identified a carrier, entered into a preliminary contract with the carrier, and have established an estimated pickup date and an estimated delivery date for your vehicle shipment. Upon dispatch, you will be contacted and informed of the timelines established.

Transport Executives will then charge your credit card our administrative fee. Once the charge has been successfully processed, we will finalize the paperwork with the carrier and you will be notified of all pertinent carrier details. This will include the name of the carrier, a contact person for that carrier, and a phone number at which you may reach them, if so desired. You may continue to use Transport Executives as your main point of contact – the choice is yours.

Point Two: 100% On-Time Delivery Guarantee
We want your vehicle to get to you in a timely manner. There are many variables in the transportation business which can lead to delayed shipments (trucks break down, etc…). However, this shouldn’t be at your expense. If we have failed you in this process then we want to make it right. At your request, a refund of our administrative fee will be issued if the following delivery timelines aren’t satisfied from the date the vehicle is picked up by one of our contracted carriers:

Shipments from 0 to 750 Miles: No more than 3 days
Shipments from 750 to 1500 Miles: No more than 7 days
Shipments greater than 1500 Miles: No more than 14 days.

The following exclusions apply:

  • If our carrier has attempted delivery within the acceptable range for your shipment, but the receiving agent was not available to receive the vehicle, then that will void your right to a refund.
  • If you have communicated delivery restrictions that may interfere with standard delivery ranges then that will void your right to a refund.
  • If we have mutually agreed, at the time of dispatch, to a date that would exceed these timelines and you approved that schedule, then that will void your right to a refund.
  • Acts of God that prevent a carrier from delivering in a timely manner.

In order to process a refund, you must fax the completed bill of lading / condition report, along with your written refund request, to 949.713.9238 within 24 hours of receipt of vehicle.

Point Three: Damage-Free Guarantee
Even the best carriers damage vehicles from time to time. This is an unfortunate reality of transporting vehicles. However, we recognize that a damaged vehicle can create an inconvenience for you that you didn’t anticipate. In such case, we will refund you the lesser of (a) actual cost of repairs or (b) the administrative fee charged for our brokering services. This is independent of the carrier’s responsibility and any insurance claims or settlements that may be generated from your damage claim. This is intended as a supplementary service to our customers and in no way renders Transport Executives liable for the damages created.

In order to qualify for a refund, the following supporting documentation must be faxed to 949.713.9238 within the timelines specified:

  • Completed and legible Bill of Lading / Condition Report, within 24 hours of receiving the vehicle.
  • Two Repair Estimates from licensed/accredited repair facilities within seven days of receiving the vehicle.
  • Receipts for repaired damages within 30 days of receiving the vehicle. Receipts shall itemize damages repaired and include those damages identified on the Bill of Lading.

Damages must have been caused by carrier negligence and the damage must be noted on the bill of lading that is signed by the receiving agent and the carrier’s driver. This guarantee does not apply to exceptions and waivers found on a standard bill of lading. This list of exceptions includes the following:
  • Minor damages such as scratches, scrapes and chips that result from normal road conditions, wear and tear.
  • Damages caused by leaking fluids, battery acids, cooling system anti-freeze solution, industrial fallout, acts of God, mechanical malfunctions, exhaust assembly, frame, alignment, tire and rim damage, suspension, wheel bearings, glass damage, overloaded vehicle, defective or insufficient brakes, parking brake or parking gear, road hazard, flying debris, etc.
  • Damage to convertible or decorative tops that are loose, torn, visibly worn, or over 2 years old.
  • Damage to vehicle boots, caps, masks, bras and any other type of covering.
  • Damage caused because vehicle cannot be driven on or off transporter under its own power.
  • Any damage resulting from failure of factory tie down brackets or frame tie down holes; failure due to vehicle’s age or condition.
  • Damage that is undetectable due to poor lighting, weather conditions, or vehicle’s dirty condition at time of pickup.
  • Loss or damage to any electronic equipment not original factory equipment.
  • Damage due to vandalism, damage to interior.
  • Damage to, or caused by: loose batteries, air diffusers, bug deflectors, loose parts, fragile or protruding accessories, low hanging spoilers, antenna, visors, rack’s of any kind.
  • Vehicles already suffering from generally poor condition.
  • Items that are not part of the inspection (e.g. mechanical or electrical systems).
  • Battery failure
  • Any damages created by loose items within the vehicle (e.g. luggage, packages, other items that aren’t insured in transit).

Versioning Information
This is a versioned document. The current version is 1.5, dated September 14, 2008. The version that applies to your order is the one that was active on the date your order was placed with our company. We will honor the version that is most beneficial to you in the event that a newer version was published on the same date that you placed your order.
